Landings Residents Go Before Council to Outline Lawsuit Filed Against Developer Kushner

PERTH AMBOY — At the November 28 City Council Meeting Landings Resident Tracy Jordan went before the Council as she has done in the past. She presented the most pressing issues in the lawsuit filed by the Landings homeowners against developer Charles Kushner on October 31, 2012.

The causes of action asserted in this Complaint include (a) violations of the New Jersey Consumer Fraud Act; (b) negligence; (c) rescission; (d) breach of contract; (e) breach of the implied covenant of good faith and fair dealing; (f) breach of warranty; (g) breach of implied warranty of habitability; (h) fraud and misrepresentation; (i) promissory estoppel; and (j) unjust enrichment.

Some of the amenities that the plaintiffs were promised were: the building of three parks, community center, Waterfront Esplanade as well as other recreational improvements.

They were led to believe that this would be an upscale neighborhood.

All of this was to be completed by 2012. Out of the 17 luxury buildings promised in the project only 2 buildings have been built.

Other amenities promised were a marina with boat slips, retail shopping, restaurants, a hotel, a 6000 sq. ft. state of the art health club. Discrete and secure underground parking, a cultural center, a high speed fairy service to New York City, especially the Wall Street Area. They also were promised a security system and owners’ cable television at all the luxury buildings.

The buildings were supposed to have been built with high grade quality construction materials and the contractors hired would only perform high end workmanship.

The defendants promised to build up and fix Washington Street which is adjacent to the Admiral and Bayview Buildings.

There was a high pressure sales pitch for potential homeowners to buy quickly since all 17 buildings would be filling up rapidly.

This was supposed to be a $600 million development project. Of the promises and representations that the defendants made to the plaintiffs none were kept.

Councilman Kenneth Gonzalez suggested maybe the City of Perth Amboy can join in with the Landings residents in the lawsuit.
